ATLANTA -- A big fight over underwear is now underway.
Atlanta shapewear company Spanx Inc. has been slapped with a claim that some of its products are infringing the designs of a New York clothing company, Yummie Tummie.
Yummie Tummie claims Spanx's "Total Taming Tank," "Top This Tank" and "Top This Cami" are violating its patents, and has demanded Spanx stop making and selling them, according to a claim filed Mar. 5 in federal court in Atlanta.
Yummie Tummie makes body contouring "shapewear" and was founded by Heather Thomson, a cast member of "Real Housewives of New York City."
Founded by billionaire Sara Blakely, Spanx makes more than 200 products, such as slimming bodywear, bras, pantyhose and swimwear. It sells products to more than 12,000 stores in 50 countries.
Forbes reported in late 2012 Spanx nets about 20 percent of its nearly $250 million in revenue, valuing the company at $1 billion.
