Rock band Muse sued for copyright infringement

(WXIA) -- British rock band Muse and Warner Music are being sued by a songwriter who says the concept for their 2009 suite "Exogenesis" came from him.

The suit was filed in federal court in New York City this week. In it, the songwriter Charles Bollfrass says he wrote a "science fiction rock opera" under the title "Exogenesis" and that he submitted it to Muse and two other bands in 2005. Muse passed on it, yet, Bollfrass claims the Exogenesis concept surfaced on Muse's 2009 album Resistance.

Bollfrass says that in addition, the cover image for Muse's Resistance CD came from his work.

The lawsuit seeks damages of $3.5 million from Warner Music.

A spokesman for the band released a statement Tuesday:

"The claim is complete nonsense, and is categorically denied. It appears to be based on a 'screenplay' which the band never received or saw, produced by someone the band has never heard of. It speaks volumes that the album in question was released a full 3 years ago, and yet this is the first that has been heard of these groundless allegations."

Warner says they will vigorously defend the lawsuit.
