Appeal denied for man who stabbed wife at Walmart

SUWANEE, Ga. -- The Supreme Court of Georgia has unanimously upheld a murder conviction and life prison sentence for a Gwinnett County man who stabbed his wife to death in 2010.

Phillip Chad Dunn's appeal was denied Monday.

Dunn was found guilty in June 2011 of fatally stabbing his estranged wife Shelley Dunn in the parking lot of a Suwanee Walmart.

According to evidence presented in court, Shelley Dunn had moved out of the house she shared with Phillip Dunn in early 2010, taking the couple's two daughters, who were 9 and 7 years old at the time.

On Feb. 14, 2010, Shelley Dunn drove to Walmart to exchange custody of the children with Phillip Dunn. Witnesses said they saw Phillip Dunn approach his wife and begin to stab her with a steak knife while their daughters screamed.

Shelley Dunn died Feb. 15 of three stab wounds to the back. Phillip Dunn also stabbed himself after attacking his wife, according to the couple's older daughter.

In his appeal, Phillip Dunn said that evidence was improperly presented at his original trial, and that the court excluded additional evidence that his wife was drunk when she was stabbed.

A Georgia Supreme Court judge rejected both arguments.
