Gary waived indictment after he was charged with one count of criminal information Wednesday morning.
Lasseter will be pleading guilty to a charge of accepting bribes in exchange for the support of a solid waste transfer station in her district.
In court Wednesday, Gary's lawyer said the businessman would be back in court in a few days to plead guilty.
Prosecutors said that in exchange for the yes vote on the transfer station, Gary gave Lasseter and her son, John Fanning, $30,000 in gambling chips from an out of the area casino.
